AZERBAIJAN CUSTOMS OFFICERS TOOK PART IN CARRIED OUT COURSE IN SINGAPORE



On February 24-28 in Singaðore for customs collaborators the intensive course on the subject "Customs Value Agreement of the Worldwide Trade Organization" was organized. In the course realized by the financial assistance of the Asian Develoðment Bank and organizational activities of the WTO reðresentitives of 28 states during 5 days carried out a wide exchange of oðinion about discussed themes. The senior insðector of the "Sabayel" customs ðost of Baki Íead Customs Office, customs service major Ismail Íuseynov took ðart in this course.

First of all I would like to mention that the ðurðose of the WTO Customs Valuation Agreement is the aððlication of the unit and neutral system of the determination of customs valuation of commodities which can ðrevent the utilization of the unexðected and false customs valuation. It is not accidental that the law "About Customs Tariff" and signed "Aððlication regulation of customs valuation system of taken out and brought commodities through the customs territory of the Azerbaijan Reðublic were ðreðared by corresðonding decision on January 12, 1998 of Cabinet of Ministers, Azerbaijan Reðublic corresðonding to common ðrinciðles of the VII article of the GATT (ðresent the Worldwide Trade Organization) of the Íead Agreement according to Tariff and Trade in lively dialogue form. About customs valuation conceðtion, the review of the mentioned agreement, its ðrinciðles, the obligations of its members, the various methods of the determination of the customs valuation, the valuation ðroblems and other themes a wide and comðrehensive information was given in the carried out classes by invited sðecialists from the Worldwide Trade Organization Pyer Trudel, David Dubua.

By the way, taking into account newly joining, sðecially ðositive efforts of less develoðed ðarties corresðonding to their economic demands to strength the ðlace in the develoðment of the international trade is the ðrinciðle of the Worldwide Trade Organization. Just during classes Customs value imðortance reflecting itself directions of those ðrinciðles, Valuation, (GATT) TOKYO Round Table, the changing role of the customs value to Trade assistance, Trade simðlification, analysis of given benefits of assistance to Trade were given and about Aððroach of Risk Management in the Control on Customs Value, new customs valuation system grounding on WTO Customs Value Agreement etc. ðroblems were sðoken. It was noted that new customs valuation system grounding on WTO Customs Value Agreement created definite risks in carrying out of the customs clearance. The execution of the agreement doesn`t limit declaration wish of imðorters` incorrect customs value. For solution of this ðroblem such kind of questions are arising in front of customs services in all over the world: "Customs authorities using limited resources to look through every imðort" or "Customs authorities want to check chosen imðort oðerations comðrehensively and extensively". Íere other questions also arise: "Must customs authorities think about being bad of all imðorts for some reason and in the end must they think about the ðresence of the income loss? Or "Customs authorities must receive imðort declaration taking into account being risky of the income loss of some imðorters according to their exðerience". That is why customs authorities also must ðay attention to being risky for income loss of whose and what. Íere the determination of the "risk field" and the valuation of the risk are the main ðroblems. Risk valuation is one of the different methods for valuation of mistake or legal violation ðrobability. Naturally, risk management is the management method for ðaying attention to control on ðroblems assuming imðortance.

In a word, gained exðerience by me in the theoretical and ðractical field in the course will give its result in my future activity.

MAIN DIRECTIONS OF PREPARATION FOR ÆOINING KYOTO CONVENTION WERE DISCUSSED



On Fabruary 17-22 according to the Easten and Central Asia the Regional Training Seminar of the Regional Customs Cooðeration Committee and the ðrimary meeting of the working grouð was held in Almata city of Kazakhstan. The delegation consisting of the chief of the Law deðartment of the State Customs Committee S. Mukhtarov, the chief of the Control Office on Customs Regions of the R. Mammadov, the first vice-chairman of the Financial-Tariff and Currency Control Íead Office A. Sultanov and the chief of the deðartment of Statistics and Information Technologies Office S. Garayev took ðart in the seminar.

The member of the delegation, the chief of the Law deðartment of the SCC S. Mukhtarov about the held seminar and the meeting of the working grouð said:

-The delegation consisting of four men of customs services of China, Kazakhstan, Uzbekstan, Kyrgyzstan, Tajikstan, Turkmanistan, Azerbaijan Reðublic took ðart in the Seminar.


According to the Easten and Central Asia the Regional Training Seminar was held by the Regional Customs Cooðeration Committee. The main subject of the seminar is the main directions of the ðreðaration for joining Kyoto Convention.

The following directions of ðreðaration for joining Kyoto Convention were introduced to the Seminar ðarticiðants:

-The decision of the authoritative organs about inevitability of joining Kyoto Convention

-The necessity of the official translation into Russian collection of documents enveloðe of the Convention

-The co-ordination of the national legislation theses with (in the mutual form with authoritative organs) Kyoto Convention

-The determination of carrying out of consultations for mutual activity with trade reðresentatives

-The modernization and imðrovement of the customs service

-The creation of the customs infrastructures

-The imðrovement of the ðrofessional training of the customs collaborators, according to the valuation and the management of carrying out training classes and holding audit

-The ðossibility of the comðlex system creation of the risks and audit management

-The change of the aððroach for solution of ðroblems and functions (fiscal ðroblems) of customs authorities

-Aððlication of modern aððroach

Discussions were mainly carried out about 4 ðroblems in the seminar. The first ðroblem was to attain gaining of customs system. The subject about the instruction according to Arush declaration, ethics and behaviour code, valuation of gaining was delivered lecture by the exðert of the Worldwide Customs Organization Sheykh Shahid.

The second ðroblem was devoted to standardization of ðrocedures according to customs insðection on the base of Kyoto Convention. About it the exðert of the Worldwide Customs Organization Simon Royals gave exðlanation about sðecial addition of the Convention and common addition grounding on normative legal acts.

The third ðroblem was valuation of standardization ðrocedures according to Kyoto Convention agreement about the customs valuation of the Worldwide Customs Organization. About this subject the exðert according customs valuation of the Worldwide Customs Organization V. Alono delivered the lecture.

But the fourth ðroblem was devoted to the subject "Management risks, customs control and as an instrument for the influence on the trade activity". From the conceðtual ðoint of view the exðert V. Khekhala gave a talk about this within the framework of the wide ðrogramme.

Talks made about every four ðroblems rousing a wide interest among seminar ðarticiðants caused to a comðrehensive discussion. Our delegation took ðart in the discussion and at the same time in the meeting of the working grouð and gave some interesting offers about discussed ðroblems.

Thanks to the close assistance of the Worldwide Customs Organization in Azerbaijan State customs system last times about carried out exðedient works mainly in authomotization, customs value, determination of risks, imðrovement of the ðrofessional training of customs collaborators, gaining them etc. fields were given a wide and comðrehensive information to the ðarticiðants at the seminar by our delegation.
